Legal Question in Wills and Trusts in California
Hello
I live in California and my sister lives in Seattle Washington.
My Mother died on 07 March 2010 and she lived in Dallas, Texas.
My Mothers Estate was very large at one time. She lived to the age of 89 and spent, used and squandered a LOT of the Estates Assets. This was a huge 2 story Brick home in upscale Dallas.
However, when my sister, Pam, also the Executrix, and I were going through our Mothers belongings in preparation for the Estate Sale we found a cache of Jewelry. This was not regular jewelry. This was not personal jewelry.
This was Victorian and Edwardian jewelry. A large collection of probably 200 pieces. Both my sister and I graded all the jewelry in the house. This we graded as Grade A. There was also Grade B, C, D, and Costume.
My sister and I spent hours individually marking and grading each and every piece.
The Grade A Jewelry looked to have been bought at an Estate Sale or a High Grade Auction House such as Christies.
We determined that the amount of this Victorian and Edwardian jewelry was worth more than the House and Property, another Property we own in Aransas County, Texas, the Sale proceeds of the Estate Sale and then more.
After my sister and I graded all the jewelry we finally finished up around 2:00am and went to bed to rest. We were to meet again at 9:00am the next morning.
When I appeared at 9:00 the next morning my sister and her husband were in the jewelry room. All the grading and seperating we had done the night before had been taken out of the graded bags and strown over tables, mixing up the jewelry again.
The first thing I said upon entering the room was "Pam, where is the rest of the Jewelry?"
She claimed she had no idea what I was talking about.
Both her and her husband had taken all of the Grade A jewelry during the middle of the night, making sure I was asleep and put them away where only they knew.
What has happened is that my sister, the Executrix of our Estate STOLE all this grade A jewelry.
They blatantly, without shame stole from our own Estate and Me.
Half of the Grade A jewelry was her's anyway by way of my Mothers Will.
But instead of being satisfied with half a fortune my sister decided to STEAL my half as well.
I estimate that half to be worth in the hundreds of thousands of dollars.
I am on SSI and have no money to fight this. This will leave me in poverty the rest of my life. My sister crapped on her own Mother's Will and wishes. She stole from her own brother.
What can I do with or with out money?
What can I do please?
