Legal Question in Wills and Trusts in California
Hello,
In January of this year, my uncle passed away. He was divorced, not currently married and had no children. His only immediate living family is his brother (my father). My uncle did not leave much, but there is $3,148.57 in his bank account. The bank is telling me I need a short certificate. From what I have read it appears the short certificate verifies that someone has been appointed as the representative of the decease will? I'm not sure what to do so thought I would ask you.
If you can help, please call me at 626-355-0273. I am in Southern California.
thank you,
Linda Ruggles, Niece of John C. Forrester, of Pittsburgh, PA

You father should submit a a small estate affidavit under Probate Code Section 13100.
If your uncle died in Pittsburgh, and was residing there, your question should be reposted in the category for Pennsylvania lawyers to answer.
Mr. Roach is correct! CA probate code will not apply if the decedent was a PA resident.
