Legal Question in Wills and Trusts in California

Hello,

My brother is the executor of our late father's estate (of which I am a beneficiary). He died in Feb of 2007 in Minneapolis, MN.

Most of the funds from the estate have been disbursed at this point except from the sale of the house. The house was finally sold in April of this year, though my brother didn't even tell me. Generally speaking my brother has been slow to handle the estate and I am still waiting for the final disbursement for the sale of the house.I have also requested more than once an accouting from him and also will & trust documents but he has either ignored my requests or refused. Is he required to send me these documents as a beneficiary of the estate?

I would assume that the basis rules hold for both states. He is required to make a formal accounting to the Court of the assets, expenses, etc., of the estate, and to supply that information to the heirs also. Demand that he supply you within the next three weeks a copy of all such documents or that he resign as administrator of the estate since he clearly does not have enough time to handle it at a reasonable speed which results in losses to both of you [the house would have sold a year ago for more than it did this year. You may be able to look at the court file on line. Once you have the information, if you are not sure about anything, you need to contact an attorney.
