Legal Question in Wills and Trusts in California

Who to hire to be power of attorney

I have a friend who is from the US and will be living in Tokyo. He needs a power of attorney in the US to handle his finances and probate issues with his Mothers Estate.

Who do you look to hire for something like this and also what is the range of fee's to be expected?

Re: Who to hire to be power of attorney

There appears to be 2 separate questions here. Regarding probate issues, is there an open probate? Fees for probate are established by statute, based on the size of the estate. Regarding his other financial agenda, he can have anyone handle them, if he trusts them. Otherwise, he will need to hire some other kind of fiduciary, such as an attorney, an accountant, a trust company, etc. Fees for that will depend on the amount of work done.

The fees are based on what professional fiduciaries (trustees, attorneys, conservators) would charge--typically there is a charge based on the value of the assets, plus extra charges for "extra work" like selling assets, completing tax returns, etc. Bank trust departments will have fee schedules for their services, so you may want to review those.
