Legal Question in Wills and Trusts in California

Is my inheritance taxable?

My Grandfather left several family members a house when he passed in 1987. His will stated my step-grandmother could live there until she no longer wanted to. She passed away last month. The will went through probate in 87. Will we have to pay capital gains if we sell it and it is not in a trust? Can we put it in a trust before escrow closes? Is the inheritance taxable? Is the tax taken from the total sale of the house or from each individuals share?

Re: Is my inheritance taxable?

this all depends upon the wording of the will, whether or not your grandmother had a will, the title for the property, the value of the property and the value of other assets in her estate. you need to retain an attorney in the county in which she died.
