Legal Question in Wills and Trusts in California

Inheritance

Years ago my father gave me his will (which was not notarized), with instructions to divide his estate between my sister and I. Now, he has become feeble because of a stroke. His ex-wife has moved back in and is taking care of him. They are not married. They have merged bank accounts. What happens to that money now? Lost forever? Could I sue after he's gone?
