Legal Question in Wills and Trusts in California

Inherited credit card debt.

The five of us lost our mother July 1999.

We inherited her credit card debt, five accounts.

Per our mother in April 1999 she gave one of us permission to charge a lot for years on one account.

The one of us that charged all this says he will consolidate all five accounts into an estate debt account.

He will not tell us the bank names or card names or account numbers.

He wants the five of us to pay equal parts to the debt account.

This tells me that their is no debt.

How can I get statements with current balance due from each credit card account before he consolidates them?

Debt is not inherited. it might have to be paid out of the assets of the estate but if there is more debt than there are assets then it doesnt get paid. Is a probate filed? if so, a complete list of assets and debts must be filed with the court.

Did you get the credit card names and numbers when the debt was left to you? You have a right to this information before you are obligated to pay the debt and until you get it I wouldn't pay a cent. Additionally, if some of this debt was incurred by your brother he is responsible to pay that portion not you. If you need additional info I can be reached at 888-563-8529.
