My grandmother died in 2004. We don't know if she had a will or not. My aunte claims that the home is in her name now. She has been on drugs a long time, and her criminal record is a mile long. Me and my younger sister live in the home, pay all the bill including the property tax. I need to know how to go about getting the house in my name because the house is in need of some major work.

You need to get the title for the property and see what has been done. If there was no will and the title was in her name alone, you will need to start a Probate proceeding. The first step is to find out how the property is titled at this time. If the home is still in your grandmother's name, then a probate may be necessary, and the home would pass to the beneficiaries under her Will, if she had one, and if not, then in accordance with state law. If the home is in the name of your aunt, I would recommend you find out how this happened (e.g. did your grandmother transfer it to her during her lifetime, etc.).
