Legal Question in Wills and Trusts in California

Inheritence

My nana passed away almost 2 years ago now and left all of us $20,000 that was put into a trust. Now within the 2 years I have been told numerous times my money would be release to me soon. They will not give me a copy of the will or the bank acct # that the trust is in. I know what bank it is in and I know that the money is being held in cash there. But my family wont give me anyother info. I was told that some of my other family memembers have recieved their share. I think my family has put it into a cd acct and are making money off of my money. Please help. What am I supposed to do!

Re: Inheritence

You mentioned both a will and a trust. I would need to see the operative documents to give you exact advice. Based on what you told me, however, it sounds like you are a beneficiary and are entitled to receive a distribution. You have a right to see the operative documents and make a demand. If the trustee is improperly making money off of your money, he or she can be subject to a surcharge. Our firm has lots of experience with these matters and we would be happy to provide you with a no cost consulation. Please feel free to contact us at (310) 787-7577.

Re: Inheritence

whomever is trustee of the trust at issue, has fiduciary duties of loyalty and due care to you as a beneficiaries. among other responsibilities therein, this would mean you are entitled to an accounting of trust assets and to receive interest and/or principal payments according to the trust instrument itself, which of of course you are within your rights to request and view by law. if you would like further assistance in this legal matter, feel free to email me directly with your contact information for a free case evaluation/consultation by phone to hopefully resolve this matter in your favor as swiftly as possible.

Re: Inheritence

From your question, it appears that there is a trust and/or will, either a possibility. Either way, if you are in fact a beneficiary from your relative, you have a right to know what in fact you are to receive and where it is. There are numerous factors that may come into play in your situation. Initially, first stage is to get copies of the controlling documents and go from there. You may have recourse, but can not know for certain until the decedent's estate planning documents are produced. If you would like, you may contact this firm for a free initial consultation.
