Interpleading

A relative has died and part of his estate is being held in escrow until some problems are resolved with family members. One attorney has suggested interpleading and another attorney said we could not do an interpleading unless the deceased was alive. Hmmm. Who is right?

You have not provided enough information to respond to a technical question. However, you can bring an action in the Probate Division of Superior Court and resolve the issues involving the estate. There may be relevant laws and documents which would control the outcome or have an effect on the respective positions of the family members.
