i was involved with a man for 5 years we have a child but he was going through a messy divorce he just passed away what are my rights

Your rights and those of your/his child will depend in the first instance on whether he had a will and/or trust. If so, those documents will likely control. You also need to look at what, if any, agreements were made in connection with his divorce. You can start by checking the Probate Court docket in the county where you live and by contacting his divorce attorney, although I suspect that you will need to retain a lawyer to protect your rights and those of your/his child.
