If I have a joint bank account with rights of survivorship and the other party of the joint checking account dies is this checking account and the funds still in the account mine?

Generally, yes, unless someone else can prove the account was intended to be something other than joint tenancy. You can provide proof of death of the other party to the bank and withdraw the funds.
