It nearly killed me
Hi,
I was a victim of the southern California rolling blackouts. I was ran down by a car at on my motorcycle while waiting to see if it was safe to proceed through a blacked out intersection. There were four other
accidents in the same vicinity. I have received settlement from the insured driver but feel this would of never happened if there was no blackout. I received Fractured Scapula, Tibia, Fibula, Sacrum, Ribs, Mild brain injury, Post Traumatic Stress disorder and a lacerated spleen. My leg is now deformed and the soft tissue damage is unrepairable. I have constant pain for life. The settlement I received paid all my bills but left me and my family next to nothing. I feel that if in fact the blackouts were created unnecessarily then those at fault have some liability in my condition. Your thoughts would be appreciated. The case would be difficult to prove against the utilities and/or the utilities commission, and it may be too late--there is a six-month statute of limitations for claims against government entities, and a one-year statute of limitations against all others. If you're within that statute, you can sue, but proving causation may be difficult.
If you have the injuries you describe, and the payment you received does not compensate you adequately, you may be out of luck if you've already signed a release to get that settlement.
