You can go to the local courthouse and obtain the proper forms. Or, you can go online to the county courts' website, and the forms should be available online.

In California, the forms are online--search for "judicial council forms." However, probate is a bit complicated, so if you plan to do it yourself, I'd recommend finding the latest books outlining the process as well, plus checking the county court's website for its own local rules.

Also, depending on the value of the assets, or the type or titling, probate may not be required. It's probably worth a consultation with an attorney to see what's involved and how much an attorney would charge--for probate it's generally a percentage fee (Probate Code section 10810) and for non-probate assets, it's typically an hourly fee.
