Legal Question in Wills and Trusts in California
In a law suit where a benificary in a trust is contesting a amended trust and the deeds to all the properties in the amended trust were not transfered into the trust does that help the people trying to make the amended trust not valid?
1 Answer from Attorneys
You really need to speak to an attorney directly about this, so you can explain all the facts and get confidential advice. The attorney should practice in the field of probate and trust litigation.
In general, the answer to your question would be "no." The trust might not be the owner of the properties in question, but that does not make the trust itself invalid. You may have facts, however, that result in a different answer.
Again, please talk to someone who practices in probate and trust litigation for assistance. You do not want advice about your case in a public forum.
