Legal Question in Wills and Trusts in California

My lawyer taking too long

Hi. My lawyer is taking too long getting our case finalized. We've been awarded guardianship over our grandchild end of last year, & the court ordered his step-parents to hand over his assets/estate etc..and to this date, our lawyers have not done anything about this. I've tried to be in contact every week, but have not heard a response back fr our lawyer. I'm afraid the estate that my grandchild's funds r in are being depleted bec of economy. what can I do? Can i ask for a refund or partial from the retainer to go to another lawyer? Thanks.

If you have any problems with your lawyer, report him to the State Bar of California. The web address is http://www.calbar.ca.gov.

You can fire the lawyer, hire another, and demand the return of any fees paid in excess of the reasonable value of the services. If you and the lawyer cannot agree you have the absolute right to demand arbitration of the fee dispute by the local county bar association. They are actually very fair.

you should consult another attorney experienced with guardianships to obtain a second opinion and determine how best to proceed at this point.
