life insurance annuity beneficiary

my mother had a living trust and all but 2 accounts were in the trust and the trust stated that all 3 of her children get the assets in the trust equally. My question is this: My mother had a life insurance annuity that somehow was not in her trust and only 2 out of the three of us were named beneficiaries. Can the one who was not named as a beneficiary fight this?

No. The beneficiary designation in the policy controls. Of course, if the kids want they can divide the annuity payout equally between the three.
