Legal Question in Wills and Trusts in California
Life insurance policy, property of estate
My father was the sole beneficiary of a life insurance policy when his aunt passed away. My father passed away before the insurance policy was paid out. There were 3 other siblings who were beneficiaries of the aunts estate. My question is, does the insurance policy go to the estate to be divided, or does the policy go to my fathers children since he was the sole beneficiary?

Theoretically, if the insurance policy was payable to your father, and he passed away after your aunt, then the proceeds should still be payable to his estate for distribution.
