Legal Question in Wills and Trusts in California

Are life insurance proceeds part of a deceased's estate?

My father died leaving a $12,000 life insurance benefit to my mother. They were married and living together. He also left a $3,000 balance on a credit card that was in his name only and under his control. Is the life insurance benefit considered a proceed of his estate? Is my mother responsible to pay the credit card balance? There are no other assets in his estate.

No, it is owned by your mother and she does not have to pay the credit cards.
