life insurance/ trust
My father recently passed away. He had 3 different life insurance policies and the beneficiaries for each one is listed as a trust with a bank that is no longer in business that he had set up in 1967. This bank has been taken over by BofA, but when I try to get information from them, they have no record of this. When I ask the life insurance companies, they say they cannot give me any info since I am not listed as a beneficiary. I am stuck! Any assistance would be appreciated!

you will need to retain a qualified attorney to assist you with this issue. it is likely that a petition for probate or a petition regarding the trust will need to be filed with the superior court in the county in which your father resided at his death. please contact my office if i can be of any assistance.

I am sorry for your loss. Your case sounds interesting. If you have no clue of the terms of the trust you likely need to do a full probate and get a Court order specifying that those assets are part of the probate estate. I do a substantial amount of this type of work so please call me if you would like to discuss in more detail. -John

Sounds like you will need to get the Probate Court to issue letters testamentary naming you as the executor of the estate. This should resolve the problem, but it can be a bit complicated. You can try ti go at it alone or retain an attorney, such as our firm, that specializes in estate planning.
