Legal Question in Wills and Trusts in California
I live in California and have 3 siblings. Stepfather died in 2009 and our mother is still alive. Three siblings (myself included) were facing a 120 day deadline to contest our parent's A/B trust because our beneficiary amount was very minimal (over-controlling bad sibling is getting 85% of the trust). The bad sibling's attorney sent each of us a letter the day before the 120 day deadline date (I was going to file a trust contest on the 120th day). The letter stated that we could not contest either side of the A/B trust because of changes made to the No-Contest provision (4 days before the 120 day deadline) and we would risk losing our 15% (5% each) share. My two questions are: Can a No-contest provision be changed right before a crucial trust contest deadline? Shouldn't the 120 day deadline be extended because of the changes made to the No-contest provision?
