Depends. A surviving spouse has certain rights to community property and an omitted spouse may have rights to even separate property. If property is titled a certain way it may not even be part of your Estate. You should meet with a local Estate Planning attorney to discuss the specifics of your Estate and how your property is held.

You need to talk to an estate planning attorney. You refer to "my money" but I can't tell from this post whether this is community property from earnings during a marriage, property that you owned prior to the marriage, or assets that would have a mixed community and separate property character.
