Legal Question in Wills and Trusts in California
When a living trust is made how is it recorded as fact? Can you just say that there is one and not have to register it in some way? My sister has a history with falsifying documents and dates for her benefit. I have found 13 different deeds to my mothers house in the 9 months before her death. They all are different spellings of my Mother and sisters names as buyer and seller. My sister was trying to avoid an IRS lien on her own house by moving both properties in and out of a "living trust". My Mothers house was paid off many years ago, yet there were a couple of loans against it. Would that not have to be revised in the "living trust " each time? Can it be used as a personal bank account? I have had prior problems with her manipulating documents and deeds in the past. I just need a direction to start at to locate this " living trust " authenticity. I do not know the attorneys name if she didnt just write them up herself.

Trust are not public information. Without knowing more it's difficult to provide guidance. You haven't stated whether probate has been opened. A child doesn't necessarily have the right to see the Trust document. Your options depend on the circumstances.
