Legal Question in Wills and Trusts in California
Living Wills
My mother is terminally ill, we, the family, may have waited to late to have her living trust completed as she previously requested. My question is can a family member write out or wishes and witness her X? She is married, if we the family members can not write it what would be a better, economical solution, at this stage of her illness? She remain coherent, but we're not sure how long that will last. please assist us.
Signed,
A procrastinating family in need of answers

Re: Living Wills
Assuming your mother is still physically and mentally able to create estate planning documents, she should consult directly with an attorney herself. She should try to find an attorney who would be willing to travel to her to assist her with these important issues.
In response to your question, she could have a family member assist in creating a holographic will. However, given the situation you describe, this is not the best way to proceed.
