Legal Question in Wills and Trusts in California

Lost contact of sibling

There was--name removed--brother and sister who lost contact with each other years ago. What happens if the brohter dies, there is no will. Would the State look for any living relative first?

Re: Lost contact of sibling

Yeah, right. The State Bureau of Looking For Long-Lost Relatives would spring into action. More likely the estate would be filched by anybody and everybody.

Re: Lost contact of sibling

The personal administrator of the estate is supposed to give notice to and make dilligent efforts to find the siblings.

Without a will, the brother's estate would be distributed under the laws of intestate. Generally speaking, if there was no spouse, no parents, and no children, then the property would pass to the siblings.

If you would like to discuss this matter further, please give my office a call.

Re: Lost contact of sibling

If brother left significant assets, the administrator of his estate would try to track down all living relatives.
