Legal Question in Wills and Trusts in California
Hi, I believe I lost my real property from the direct result of my attorney's misrepresentation or incompetence or both.
The first 11/2 years of my father's trust administration I was not disclosed many important issues. My attorney convinced me that he had a secret stradegy up his sleave and if anything didn't make sense to me don't worry, everything's fine. I trusted him. I was isolated from the final accounting at mediation. Nothing made sense to me but my attorney kept reassured me everything is cool. I was coerced into signing obvious documents I wouldn't normally sign if it wasn't for my trust in a secret stradegy.
This happened 2 1/2 years ago the closing of the administration. I lost everything, my real property, my business, most of my personal assets. I couldn't believe what had happened to me. My attorney helped out m,y sister into being owner of my once real property.
I believe a legal transfer never happened because 1., no meeting of the minds, 2., no valueable consideration, no disclosure. My attorney convinced the Court that my property was supposed to be a trust asset. I finally got hold of a document showing there never was a trust. My father revoked it before he died. So there was never a trust from the beginning.
If I can show the Court there was never a trust can I take this back to court and fight for my property back? These people had a brilliant plan and were trying to provoke me into doing something stupid so I would lose everything. I have kept my cool and have lots of evidence. Thank you sincerely, J.C.
