Legal Question in Wills and Trusts in California

minimum duration

Assuming a simple straightforward estate, does the required amount of time

probate must remain open (4 months?) start from the time of publishing notice

of probate in the paper (to notify creditors) or the date the judge makes me

official executor (as stated in will) by signing the letters testementary.

Thanks!

Re: minimum duration

It starts with the issuance of the letters. Once the 4 months have passed for creditors to file claims against the estate, the executor must prepare a final accounting and request an order of distribution and termination of the probate. That can take at least another 2 months.
