Legal Question in Wills and Trusts in California

minimum estate value for probate

A living trust was left as well as a will. The only items in the will are tangible personal property-vehicles, the furniture, etc. Does a probate need to be filed for the tangible personal property items or is there a minimum value of an estate for a probate? If probate proceeds, where does the money to pay for the proceedings come from?

Thank you

Re: minimum estate value for probate

Question 1: Does the will, or the trust have a residual/pour over provision for personal property or for property not listed, ours always carry this provision.

Question 2: Is the personal property to which you refer valued at $100K or more?

The estate must be in excess of $100,000 to require probate. If things are properly funded to the trust, then the distribution of those assets are done according to the terms of the trust.
