moms estate

My question is, do i have the right to use my moms $1100.00 checking acct. to pay for funeral exspences

before one of moms credit card bills? and second she has a clear title to a 9 year old car, can i get that in my name or a siblings name without it going to a credit card bill company?

facts: 1.) i have a will of the generic type

" california statutory will " with property disposition box filled out to " my children"

2.) mom has roughly 1100.00 dollars in bank acct.

3.) mom has a car and a title that is paid off

2000.00 or less i guess its value.

4.) a credit card bill came in the mail with roughly a 5000.00 balance, but im hoping there insurance will cover it cause mom is gone? maybe another credit company but it hasent come thru mail yet?

5.) we are 3 grown children, but not rich.

can we have money for funeral and can we keep car, basically is the questions? sorry the way i typed this thank you!!!!

Yes, it sounds like your mother has a small estate worth less than $100,000. If that is the case, there is a simple procedure that you can do to the probate court without having to do a full probate.
