Legal Question in Wills and Trusts in California

Money was put in a trust for me and 4 other silbings 40 years ago to be received when my mother died. My mother received a monthly stipend but recently has been cashed out. The remainder was put into a closed account for the rest of us until my mom dies. The lawyer handling the division of the money said he would not advise the accountant in charge to release it to us because if we should die before our mother our children could sue. If my children (32 & 20 years old ) give a letter relinquishing any claim to the money could it be released?
