Legal Question in Wills and Trusts in California
My mother died leaving a trust that specifically left out a sister who had refused to pay back loans. Another sister and I asked that she be put back in the trust with the provision (in writing) she pay back the loans. She agreed and signed a promisory note. However, she has defaulted on the note. Can we ask that she be removed from the tust? That would require her to pay back substantially more money and make a legal action more worthwhile..
