Legal Question in Wills and Trusts in California
My mother passed away and left my brother as executor of the will. She left her house and property to be split between us both, but left the $325,000 cabin to just my brother. My brother is charging an executor fee for the cabin, is this the right thing for him to do?

If a probate proceeding is necessary to carry out your mother's wishes, the executor is entitled to receive a fee based upon the value of the entire estate.
