Legal Question in Wills and Trusts in California

My mother passed away and my sister is the trustee and both of us are the only beneficerys. many of the items in the estate are missing and my sister can explain where they are she says they may of been stolen. can she held liable for this cituation.

I'm sorry you're in this difficult situation--she would most likely be liable for the items missing after she became trustee. Your difficulty is in proving what was in the estate at your mother's death. If this is possible, see an attorney about the possibility of pursuing your sister for breach of her fiduciary duty.
