Legal Question in Wills and Trusts in California
My mother and step-dad filed and won guadrianship of my 5yr. old in probate. Everything filed was false. I have substancial proof of this. Count after count of false addresses, convictions, of my childs residence, about him not being on aid when he was still living with me (they stated he always lived with them), not serving me with a single notice, outside slander, ect. It gets worse. The judge never repremanded them for failing to serve me, never looked at my records to disprove allegations, and never provided me with any information about my rights, and I was never told I was entitled to public representation. I've been to four court hearings contesting the matter, I missed one and custody was given to my parents!
I know what I want to file but Im not sure how and in which order to file my cases
I've filled out 32 Intentional Torts (cover libel?) with an App. to show cause, Affidavit of facts constituting contempt, Exemplary Damages, and request for special notice.
Then Im not sure but I think I submit a petition to terminate, followed by Request for Hearing and Application to Set Aside Support Order, and...an Intention to file a writ (because the 60 period is about to run out).
1 Answer from Attorneys
Go to the County Bar association nearest to the courthouse and see if they have a pro bono program with attorneys who practice guardianship/conservatorship law in that courthouse. You need someone who can file out the proper paperwork for you and appear with you in court.
