My father-in-law recently passed away, there was a will and he had wished that my husband get his half of the house and property. But after his death the will mysteriously disappeared. Which of course we can not prove. His wife said that they house was community property. But we just recieve a document from her lawyer regarding a probate hearing. Does this mean my husband might be able to claim his part of the house? And should he attend the hearing? Is there any way he can fight for his part?

Who drafted the will, perhaps if an attorney did he would have copy. Was the house purchased during marriage? Do you know the source of the money used to purchase it? You may always assert a claim which may be resolved via settlement. Call me directly at (619) 222-3504.
