If my mother's estate is less than $100,000 will we avoid probate?

Most likely you will avoid a full probate if the date of death gross value of your mother's estate is less than $150,000. But depending on the type of assets, you may still need to file something with the probate court. Also, you should consider whether a full probate is beneficial based on your mother's creditors.

You wouldn't necessarily avoid probate all together, but depending on where and how the assets are held, you may be entitled to a small estate probate.
