Your question appears to be incomplete, but as a rule, the owner of the property (even a successor trustee of a trust or executor of a probate estate( can evict you. If you're not paying rent, you're technically a "gratuitous guest" who can more or less be kicked out without notice. However, the authorities won't help them kick you out so the owner, if doing it cautiously, would provide you with 30 days notice if you lived there for less than a year or 60 days notice if you lived there for more than the last year, followed by an eviction action if you don't leave.
