My Mothers Will

How can I find out what my mother stated in her will if my siblings refuse to speak to me and they have possesion of all her belongings?

Re: My Mothers Will

If a petition for probate has been filed you should be one of the individuals noticed. If a petition for probate has not been filed, you can file one and indicate you want to be the executor. All wills will then have to be sumitted for probate.

This does not constitute legal advise, and we are not your lawyer, unless and until, we are formally retained.

Re: My Mothers Will

If there was only a will and your mother owned a home or had assets in excess of $100,000 (no deduction for amounts still owed) then you will probably need to open a Probate. Unfortunately, a will without a trust does not avoid Probate.
