Legal Question in Wills and Trusts in California
Mr. Linden...Thank you for answering my question regarding a Trust distribution and witholding funds in the event I might need to hire an attorney. In answering your questions...Yes they have threatened to take me to court. Very long story short...my sister (one of the beneficiaries) was the first Trustee. She mismananged the funds. I am going to withdraw from her portion the money she can not account for..but that's it. They want me to do more than that and I am not going to. Obviously there is much more to this story...but I won't go into it. So...two of the 6 beneficiaries will argue but the other 4 will not. Does that make a difference? Do all beneficiaries have to agree to prosecute?
Also...I have done alot of work on this Trust and I will be taking the max allowed for my "trustee fee". My fee will be based on the $235,000.00 made on the sale of property left to us. I have heard I can take as much as 10%...can you clarify this for me? I'm certain they won't like this either...so I have to make sure what I take is legal.
