Legal Question in Wills and Trusts in California

my niece has 3 children with the same man..they were never married...recently she

was told that the childrens great grandfather died in Utah..do her children have the

same rights as the great grand children whose parents are or were married?

This would obviously first depend on if the decedent had a will or trust. If you are asking about intestate succession (no will) then the answer is that the statute looks to blood lines, not marriage. The children would have to be able to prove that they are direct issues, but if that can be established, then there should not be a problem.
