Legal Question in Wills and Trusts in California

Notorey Public makes inheritance legal

My brother is going to inherit my mother's assets. He signed a letter in front of a notory to give half of everything to me, is this legal?

Re: Notorey Public makes inheritance legal

Thank you for your question. Unfortunately, I can give no direct answer since much more is required to make a document legal than it being notorized. However, without more explanation why he would give you half, it seems that even if it were legal, nothing would stop him from changing it tomorrow.

If you need legal assistance, I am willing to help. If you so desire, call me at (408) 268-2580.

You need someone to look at the document to give you a "legal" answer. The question is not whether a "gift", if it is a gift, is legal, the question is whether the "gift" is enforceable.

Re: Notary Public makes inheritance legal

Notarizing something means the notary is either verifying your identify or noting that the person being notarized is making an oath regarding the truth of something on the document.

What you really need to know is whether your brother's promise to give you half of the inheritance is enforceable, and even if so, will it happen? You may want to review the matter with an attorney who can look at all the relevant facts and documents.
