I depends on how you own the house.. If you own it as an individual, the house would go through probate and pass to your closest living relatives (i.e., children, parents, and on and on). Ultimately the court would look at who is closest in relation and give it to that person or persons.

If you own it with someone else, you will have to look at how title is held to determine the issue.

Utimately, however, having a will or trust can ensure that the house would pass to whomever you wanted it to pass to.

Depends on how you hold title and what relatives you have (spouse and children are first in line.)
