Legal Question in Wills and Trusts in California

Parent dies intestate

My father passed away in 2006. My mother passed away in 1995. I am an only child living in another state. My father left no will. His estate consists of an IRA and checking account totalling less than $20K. He left no real property. I am starting to receive his medical bills. What can I do to use his assets to pay his bills? Thanks.

Re: Parent dies intestate

Nevada law allows for estates under $20k to be resolved through an affidavit process that is quite streamlined. If you are the only legal heir and you can assert that all bills are paid or will be paid from the estate assets, you can make the affidavit and obtain control over the assets without having to go through the probate process. Any competent Nevada probate attorney should be able to assist you with this at a fairly minimal cost.
