Legal Question in Wills and Trusts in California

My parents have an AB trust. My dad passed away in 2006 but my mother did not split assets into an A and B trust. She was unaware she had to do anything to the trust. What will happen when she passes? I am the successor trustee. I have a brother who is the other beneficiary but he will not contest anything.

The trust documents should be reviewed to determine what should be done now. The tax benefits of the A B trust situation may be lost if something is not done while your mother is alive. Your mother should consult with an attorney.
