Legal Question in Wills and Trusts in California
parents living trust
I have become estranged from my brother who is named as the executor/trustee of my parents estate, which is in a living trust. (My parents are both alive and well currently). I am concerned that in the future he may use that position to do what is not in my best interest. Can he ''steal'' take property/cash/bonds at his discretion without my input? I have expressed this to my Mother who told me he can't do this however, this is not what I have been reading on the net. My father told my brother at a meeting at which I was present that ''he (my brother) would be in charge and that he would not do anything that was not in his brothers best interest as well as his.'' This last bit is not to comforting. Any suggestions or input would be greatly appreciated. Thank you for your time.

Re: parents living trust
Make sure you retain a good relationship with your parents. It is important that your borther know how to reach you, so make sure he has your address. Pay particular attention if and when your parents start losing capacity. I have a book coming out soon entitled Inheritance Theft. Send me an email and I'll let you know once it's published.
