Legal Question in Wills and Trusts in California
My parents have a LIVING TRUST and want to remove the two people listed in the trust. (One has passed away and the second is my brother who my parents no longer want to have involved in the trust.) My parents want everything to do to me. How is this done?
Also, these documents are probably more than 10 years old. Does this matter?

Dear Cindy - I always recommend that clients review their trusts with an attorney every couple of years just to make sure everything is still in order. Your parents are a bit overdue. Amending the trust to change successor trustees should be fairly simple since the trust should be fully revocable during your parents lifetimes. I would be happy to review the trust with your parents at no charge and then help with whatever changes are needed at an agreed upon fee. Simply changing a trustee should be a fairly inexpensive change to make.
Mr. Feldman is correct. An amendment to the trust documents is the way to go and fairly simple. I suggest you find an estate planning attorney local to you.
