Legal Question in Wills and Trusts in California

My partner of 16 years died (9/31/11) we have to minor children together. We recently seperated (2/8/2011) but were on good terms. He never divorced his first wife. He left behind tools, furniture and a work truck and a car. Do these things which he accured during our time together belong to his wife? What should i do to protect my children?

If your partner was separated from his wife, then most likely the community estate ended. The community estate definitely ended if there was a formal separation. If your partner did not have a will, then his assets should be distributed to his children. All the minor children will need a guardian appointed to manage their inheritance so long as it is over $10,000.
