Personal belongings

mother deceased and I am unable to retrieve her personal belongings out of the condo she was living in due to daughter in law will not let me in the condo. What can I do legally? My mother died suddenly and had no will. I am her only daughter and she also has two sons.

Please accept my condolences. If your mother's estate is worth under $ 100K then you may obtain title to her assets via declaration. If it is over $ 100.00K then it must go through probate. Contact me directly.

When a person dies in California with no will, they die "intestate" and the laws of intestate succession are used to determine who inherits the estate. If your mother was not married at the time of death, normally the decedent's children take in equal shares. I have many questions I would ask to provide additional advice. Is your brother living in the condo also? Or is the person not allowing you in related only by marriage, not blood? You and your brothers are probably entitled to the estate equally but I would need more information. You are free to contact me if you would like to discuss further.
