Legal Question in Wills and Trusts in California

How to Petition for an Accounting

How do I Petition the Courts In Pro Per requesting an accounting of the Trust. My father left everything in a trust to be divided equally between my brother and myself. My brother is first successor trustee and I am second. I am concerned that my brother is liquidating all the assets and dispite numerous requests, I am not able to find out what is left if anything. Also, is there a way to put a freeze on this case and have an auditor check into a home loan I obtained to buy out my brother's half interest in my Dad's home? It appears my brother's attorney received my complete loan for $130,000 instead of $75,000 that was due to my brother. The rest of the loan was to pay off my current loans, none of which were paid and now I am faced with my current monthly payments and an additional $1,400 mortgage payment that is impossible for me to pay. I fear I will lose my Dad's home. Please advise.

Re: How to Petition for an Accounting

You are going to be required to file a legal action with the court. Chances are, you will need the services of an attorney. If you get an attorney to make contact with your brother's attorney, you may avoid that problem.
