Legal Question in Wills and Trusts in California
Should I Become Power of Attorney?
My dad is going to jail in a month for
having a DUI accident. He is probably
going to be in jail for 3-5 years. While
he is gone, we want to get his house
rented out so that we can still make
the mortgage payments for him. Do I
need to become Power of Attorney to
help him do this? I may need to sign
things for him and make decision
regarding his home and his other possessions while he's gone. If I do
become POA, am I held responsible
for his debt. He owes a lot of money
to the IRS, bills, credit cards, etc...
Am I putting myself in a bad
situation by getting involved?

Re: Should I Become Power of Attorney?
You're not personally responsible for his debt. His debts remain his alone.
